The proposed demand for National Commission for the General Category (NCGC) is envisioned as a constitutional or statutory federal body tasked with safeguarding the socio-economic, educational, and legal interests of the unreserved categories in India.
Advocacy groups demanded that the NCGC be granted powers equivalent to those of the National Commission for Scheduled Castes (NCSC) and the National Commission for Backward Classes (NCBC) under Article 338 of the Constitution.
The proposed core roles and functions of the NCGC are structured around five primary areas:
1. Investigation and Grievance Redressal
Investigating Rights Violations: Entrusted with the power to examine and investigate all matters relating to the safeguards provided for the General Category under the Constitution or any other law.
Inquiry into Specific Complaints: Functioning as a dedicated forum to look into specific complaints regarding the deprivation of rights and safeguards of unreserved category citizens.
Civil Court Powers: Empowered with the authority of a civil court to summon witnesses, discover documents, and receive evidence under oath while investigating grievances.
2. Socio-Economic Welfare and EWS Oversight
Monitoring the EWS Quota: Overseeing the strict and transparent implementation of the 10% Economically Weaker Sections (EWS) reservation across central educational institutions and public employment.
Poverty Alleviation Strategies: Formulating targeted welfare schemes and socio-economic developmental strategies specifically aimed at the impoverished and illiterate populations within the forward castes.
Income-Criteria Evaluations: Regularly reviewing and recommending adjustments to the income and asset criteria used to define eligibility for economic welfare benefits to ensure true beneficiaries are reached.
3. Protection of Educational and Employment Merit
Safeguarding Open Merit: Ensuring that minimum qualifying marks (cut-offs) and procedural transparency are strictly preserved in open-merit admissions and recruitment tiers.
Amending Inclusive Frameworks: Evaluating and proposing amendments to University Grants Commission (UGC) Equity Regulations and other federal welfare policies to ensure vulnerable General Category students are formally integrated into institutional support systems.
4. Legal Safeguards and Systemic Review
Preventing Legislative Misuse: Conducting structural reviews and suggesting safeguards (such as mandatory preliminary inquiries) to prevent the weaponization or misuse of stringent laws like the SC/ST Prevention of Atrocities Act against innocent citizens.
Empirical Assessment (White Paper): Commissioning macro-level socio-economic surveys to publish a comprehensive federal White Paper evaluating the multi-generational impact, distribution, and efficacy of India's reservation system over the last 75 years.
5. Advisory and Reporting Functions
Annual Reports: Presenting annual and special reports to the President of India regarding the socio-economic status, grievances, and the efficacy of safeguards protecting the General Category.
Policy Recommendation: Advising the central and state governments on socio-economic planning, legislative drafts, and policy execution impacting unreserved demographics.
